Lawsuit against Uber certified to proceed in Ontario Court

On Thursday, August 12, Ontario’s Superior Court of Justice certified a class-action lawsuit against Uber Technologies Inc.

Judge Justin Paul Perell released his decision late on August 12. The decision stems from a court filing made by Samfiru Tumarkin LLP and Uber Eats courier David Heller in 2017.

This certification will advance a fight to get some of Uber’s Canadian couriers and drivers recognized as employees and occurs as Ontario’s Ministry of Labour conducts a consultation on “the future of work.”

Road Warrior News (RWN) is interviewing stakeholders in the case at present and will have updated coverage and comment shortly. RWN predicted the likelihood of lawsuits against Uber in Canada in a June 30 editorial.
