October 15 expert plaintiff’s report, Metro Taxi vs Ottawa
Correction: There are no “oral” submissions to be made on October 15, 2025; in fact, on October 15th, class council will provide an expert report document to the City of Ottawa. Expert reports will be made public once they are entered into evidence, which is expected when the trial resumes in March 2026. Taxi News regrets the error.
On May 13, 2024, Justice Marc Smith issued his decision in the case of Metro Taxi Ltd., Marc Andre Way and Ishkak Mail vs the City of Ottawa. Justice Smith found that the “the City’s response to Uber’s arrival was negligent, causing harm to the taxi industry.” The class action seeks $215 million in damages.
On April 4, 2025, the trial Metro Taxi et al vs. City of Ottawa resumed for the hearing of oral submissions on the aggregate damages issue. The matter was adjourned because the Court was of the view that expert evidence was required to determine this issue. The trial is scheduled to resume during the week of March 30, 2026.
The parties have agreed to the following timetable for the exchange of expert reports:
Plaintiff’s expert report: October 15, 2025
Defendant’s expert report: January 9, 2026
Plaintiff’s reply report (if any): February 27, 2026.
Expert reports will be made public once they are entered into evidence, which is expected when the trial resumes in March 2026. Taxi News will post the documents immediately as they become available.
