Reading coverage of the Transplace purchase and other recent Uber-themed articles in logistics media, you could almost get the impression that Uber is a profitable, efficient company generously looking to share its success with outdated trucking and logistics industries that have somehow struggled along without its help for a century.

Who will be first to sue Uber in Canada?

However, as of July 1st 2021, Uber Canada will be located in Canada. Up until now, its head offices have been located in the Netherlands, a situation which has allowed it to avoid paying many of the same taxes competing Canadian business are required by law to pay. Uber’s “Double Dutch” tax avoidance strategy has been well investigated in other articles which are well worth reading.

Less well investigated is what we might call Uber’s “Lawsuit Avoidance Strategy,” which up until now could be summarized as: “Hide in the Netherlands and make anyone who wants to sue you, for any reason large or small, fly to Europe and find you in order to get their day at the Hague.”

As a result of losing its case before the Supreme Court of Canada in March of 2021, Uber Canada has decided to move its Canadian head office to Canada from the Netherlands, where it has been located for years as part of a complicated web of entities and transactions which have allowed it to avoid taxes and lawsuits.

Toronto taxi plate owners’ day in court denied again

The Toronto taxi plate owners’ attempt to have a $1.7-billion class action suit certified against the City of Toronto has been dismissed again.

Co-appellants Lawrence Eisenberg, Behrouz Khamzeh, and Sukhvir Thethi were appealing a December 2019 Ontario Supreme Court decision which denied their claims that the owners’ huge loss of business to Uber stemmed from the City’s failure to enforce its by-laws against the Silicon Valley-based ridesharing giant (particularly in the period from 2014 to 2016 when Uber rolled out its unlicensed Uber X service, gaining significant market share while operating outside the law).
